Many of you have been feeling the same mix of anxiety and frustration I have these past few weeks.
We’ve all been waiting for the Equality and Human Rights Commission (EHRC) to release its updated guidance on single-sex spaces….
…guidance that will have major consequences for transgender people across the UK.
Here’s where things stand right now:
The EHRC has finished its work on the new Code of Practice covering services, public functions, and associations.
- They have submitted the final draft to the Minister for Women and Equalities, but it hasn’t yet been laid before Parliament or published publicly.
- We cannot read the final text yet – only the consultation draft from earlier this year and what the EHRC has hinted about its contents.
Based on everything we’ve seen, this guidance will likely interpret “single-sex” as meaning biological sex only, excluding trans people from spaces and services we’ve always used safely and respectfully – toilets, changing rooms, hospital wards, support groups, and beyond.
It’s scary because until we see the final text, we don’t know the full extent of the restrictions or exactly how service providers will be told to implement them.
What This Means for Us
- Nothing has changed yet – this is still guidance, not law.
- We’ll have a chance to read the final version once the government lays it before Parliament.
- At that point, there will be ways to challenge, push back, and campaign.
