We are deeply disappointed to see that the EHRC’s revised guidance continues the direction signalled following the Supreme Court ruling, including language and proposals which many trans people will experience as exclusionary, invalidating, and dehumanising.
We know today will be particularly difficult for many in our community. News and social media coverage is already circulating widely, often with sensationalist headlines, exaggeration, and misinformation.
Please remember:
- This is still guidance, not a brand new law.
- The draft has now entered a 40 sitting day parliamentary scrutiny period, meaning this process will continue well into the summer.
- Different organisations will interpret and implement this guidance differently, so real-world impacts are likely to vary significantly.
- Trans people still remain protected under the Equality Act 2010.
While this development is serious, it is also not entirely unexpected. Advocacy groups, legal organisations, and community networks have been preparing for this possibility for some time and are already reviewing the draft in detail.
Right now, the most important thing you can do is look after yourself and those around you.
If you are trans:
Please step away from the doom-scrolling where possible. You do not need to absorb every headline, debate, or social media argument today in order to stay informed.
If you are a cis ally:
Check in on your trans friends, family, and colleagues. Many people are exhausted, frightened, and overwhelmed by seeing their lives debated so publicly and relentlessly.
As the practical implications become clearer, there will be opportunities for action:
- contacting MPs,
- supporting advocacy organisations,
- helping inclusive organisations remain confident and informed,
- and challenging misinformation where appropriate.
Most importantly: trans people are still here, still part of society, and still deserving of dignity, safety, and participation in public life.
Community matters now more than ever.
Take care of yourselves and each other.
